This document presents the conditions that regulate the use of this website and the contract that binds both parties. These Conditions establish the rights and obligations of the users and those of TERESA BERGAMOTA in relation to the products and services that we offer through this website www.teresabergamota.com . By using this website or placing an order through it, you agree to be bound by these Terms of Service, the Shipping Policy and our Privacy Policy, so if you do not agree with all of them, you should not place an order. These Terms may change, so you should read them before placing each order. By placing an order through this website, you warrant to us that you are over 18 years of age and that you have the legal capacity to enter into this Agreement.

These Conditions are the only conditions applicable to the use of this website and supersede all other conditions, unless TERESA BERGAMOTA gives its express prior written consent. These Terms are important to both you and us as they have been drawn up to create a legally binding agreement between us protecting your rights as a customer and our rights as a company. Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of information transmitted or obtained through this website unless expressly stated otherwise on this website.

You declare that, by placing your order, you have read and accept these Conditions. All orders for products are subject to availability and, in this regard, if supply difficulties occur, or if items are out of stock, we reserve the right to provide you with information about substitute products of equal or superior quality and value which you may order. If you do not wish to order such substitute products, we will refund any money you may have paid. The products we sell, especially handmade products, can often have the characteristics of the natural materials used in their manufacture. These characteristics such as variation in grain, texture, knots and colour are not to be considered defects or flaws. On the contrary, they should be expected and appreciated. We only select products of the highest quality, but natural characteristics are unavoidable and must be accepted as part of the individual appearance of the product.

The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due. The price of each product will be the price stated on our website at any given time, except in the case of obvious error. Although we try to ensure that all prices shown on the site are correct, errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and you will be fully reimbursed for any amounts paid. By default, we present prices including Value Added Tax (VAT). Any purchase within the VAT zone of the European Union is subject to VAT, unless you are a business outside Spain with a validated VAT number (NIF) for intra-community transactions. For deliveries outside the European Union and its VAT zone, VAT is excluded, and taxes on arrival of the package are payable by the customer.

We will not be obliged to supply you with the product(s) at the incorrect lower price (even if we have sent you a Dispatch Confirmation) if the pricing error is obvious and unmistakable and could reasonably have been recognised by you as the incorrect price. Once you have made your purchases, all the items you wish to buy will have been added to your basket and the next step will be to process the order and make payment.

To do so, the steps are as follows:

Click on the “Finish Order” button.

Fill in or check the contact information, the details of your order, the address to which you want the order to be sent and the address to which the invoice is to be sent.

Enter your credit card details.

Terminate the transaction.

This information and the details contained in this website do not constitute an offer to sell, but an invitation to do business. No contract will exist between us in relation to any product until your order has been expressly accepted by us (even if your account has already been debited). If your offer is not accepted and your account has already been debited, the amount of the debit will be refunded to you in full.

To place an order, you will need to follow the online checkout procedure and “authorise payment”. You will then receive an email acknowledging receipt of your order (the “Order Confirmation”). Please note that this does not mean that your order has been accepted, as your order constitutes an offer you make to us to purchase one or more products. All orders are subject to acceptance by us and we will confirm such acceptance by sending you an email confirming that the product is being shipped (the “Shipping Confirmation”). The contract for the purchase of a product between us (the “Contract”) will only be formed when we send you the Dispatch Confirmation. Only those products listed in the Dispatch Confirmation will be the subject of the Contract. We shall not be obliged to supply you with any other products that may have been ordered until we confirm the dispatch of those products to you in a separate Dispatch Confirmation.
